Terms of Service

1. Acceptance of terms

By accessing or using RentUp's website and services, you agree to these Terms of Service and any additional terms posted on the site. If you do not agree, do not use our services.

2. Services

• RentUp provides marketing, lead generation, tenant communication, showing coordination, and leasing support for property owners and managers.
• Services may include posting listings, responding to inquiries, scheduling showings, providing reporting and analytics, and consulting on leasing strategy.
• Any additional services must be outlined in a separate agreement.

3. Service limitations and disclaimers

• RentUp does not guarantee tenant placement, lease execution, rental income, or occupancy.
• RentUp is not responsible for tenant qualifications, background checks, credit checks, or any third-party services unless explicitly contracted.
• Services are limited to the scope described in your agreement; RentUp is not liable for outcomes beyond lead generation, communication, and scheduled showings.
• RentUp is not responsible for actions, decisions, or performance of tenants, onsite staff, or other third parties.

4. User responsibilities

• You must provide accurate, complete, and current information regarding your properties.
• You must comply with all applicable laws, including fair housing, privacy, and local rental regulations.
• You are responsible for all leases, deposits, fees, and interactions with tenants.
• You agree to cooperate with RentUp's service processes and provide any requested documentation.

5. Fees and payment

• Fees, including management fees, per-showing fees, and prepaid packages, are as outlined in your service agreement.
• Payments are due according to the terms specified; late payments may incur additional charges.
• Fees are non-refundable unless explicitly stated.
• RentUp does not charge tenants; all fees are billed to property owners or managers.

6. Data collection, use, and privacy

• RentUp collects and stores property, tenant, and user data to provide services and improve operations.
• Data may be shared with third parties only as necessary to perform services or as required by law.
• You consent to RentUp using anonymized or aggregated data for reporting, analytics, and business development.

7. Intellectual property

• All content, software, graphics, text, and materials provided by RentUp are owned by RentUp or its licensors.
• You may not copy, distribute, reproduce, or create derivative works without written permission.

8. Limitation of liability

• Services are provided "as is" and "as available."
• RentUp is not liable for indirect, incidental, special, consequential, or punitive damages, including lost income, profits, or business opportunities.
• RentUp's total liability for any claim shall not exceed the fees paid by you for the specific service giving rise to the claim.

9. Indemnification

You agree to defend, indemnify, and hold RentUp, its officers, employees, and affiliates harmless from any claims, damages, liabilities, costs, or expenses arising from your use of services, violation of these Terms, or violation of applicable laws.

10. Termination

• RentUp may suspend or terminate your access for violation of these Terms, illegal activity, or conduct harmful to RentUp, its employees, or other users.
• Termination does not relieve you of obligations to pay outstanding fees or indemnify RentUp.

11. Dispute resolution and governing law

• These Terms are governed by the laws of the State of Colorado.
• Any disputes will be resolved in the courts located in Denver County, Colorado.
• You waive any right to jury trials for disputes arising from these Terms.

12. Modifications

• RentUp may update these Terms at any time.
• Updated Terms take effect upon posting on the website.
• Continued use constitutes acceptance of the updated Terms.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force.
